Extended Service Plan Terms and Conditions

1. Introduction

This Extended Service Plan (the “Plan”) is offered as an optional addition to your purchase of the following major appliances: refrigerators, freezers, ovens, washers, and dryers (the “Appliance(s)”). This Plan is provided and serviced by 2668780 Alberta Ltd, doing business as Tred Appliances (“Tred Appliances” or “we”). By purchasing this Plan, you agree to the following Terms and Conditions. Please read them carefully.

2. Coverage

The Extended Service Plan provides coverage for the repair of your covered Appliance(s) under the following terms:

• Coverage Period: The Plan covers services for a period of three (3) years, beginning the day after the expiration of the Appliance’s original manufacturer’s warranty.

• Servicing Area: The Plan is only valid within the serviceable area of Tred Appliances. The service area is limited to the geographic area specified by Tred Appliances and may be subject to change. Service requests outside of this area may incur additional fees or be declined at the discretion of Tred Appliances.

• Covered Services: During the coverage period, the Plan includes both labor and parts necessary for the repair of your Appliance(s). The repair must be due to a mechanical or electrical failure.

3. Exclusions

The Extended Service Plan does not cover the following:

• Physical Damage: Any damage caused by misuse, mishandling, accidents, or acts of nature (e.g., fire, flood, or extreme weather conditions).

• Cosmetic Damage: Scratches, dents, or other cosmetic damage that does not affect the functionality of the Appliance.

• Uncommon Use: Any damage or malfunction due to improper installation, alterations, or use of the Appliance for any purpose other than its intended household use.

• Consumable Parts: Items such as light bulbs, filters, or other parts that have a limited useful life or are intended to be replaced regularly are not covered under the Plan.

• Pre-existing Conditions: Any issues or damages that existed before the Plan’s coverage period begins (i.e., during the manufacturer's warranty).

• Wear and Tear: Normal wear and tear and the need for regular maintenance and overhaul will not constitute a defect or nonconformance under this Plan.

4. Eligibility for Purchase

• Purchase Requirement: The Extended Service Plan can only be purchased on the same day as the purchase of the major Appliance(s) listed above. The Plan is available only for new major appliance purchases, and is not applicable to used or previously owned items.

5. Service Requests

• Eligibility: To be eligible for service under the Plan, you must contact Tred Appliances within the coverage period, and the Appliance must be located within the serviceable area.

• Service Fees: There may be a charge for service outside of normal working hours or outside of the service area, and you will be informed of any applicable fees prior to any service being performed.

• Authorized Service Providers: All repairs must be conducted by authorized technicians or service providers designated by Tred Appliances. Unauthorized repairs may void the Plan.

6. Termination of the Plan

The Plan will be automatically terminated under the following circumstances:

• If the Appliance is deemed irreparably damaged or destroyed.

• If you transfer ownership of the Appliance to a third party, except where allowed by applicable law.

• If you violate any of the terms of this Agreement.

7. Limitations of Liability

Tred Appliances’ liability under this Plan is limited to the repair or replacement of the Appliance’s faulty parts. Tred Appliances shall not be liable for any incidental or consequential damages, including but not limited to loss of use, inconvenience, or financial loss due to the failure of the Appliance.

8. No Warranty

The Extended Service Plan is not an extended warranty. It is a service plan designed to provide repair services for the Appliance(s) during the specified coverage period. This Plan does not affect or extend any manufacturer's warranty, nor does it substitute for a manufacturer's warranty.

9. Transferability

This Plan is non-transferable, and coverage is limited to the original purchaser of the Appliance(s).

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under or in connection with this agreement shall be resolved within the jurisdiction of the Alberta courts.
